Terms & Conditions for My Verizon Usage Controls

In addition to these Terms and Conditions, FamilyBase is also subject to your Customer Agreement and the Verizon Wireless Privacy Principles (which are available at http://www22.verizon.com/about/privacy/).  FamilyBase (previously “Usage Controls”) requires a supported device on a supported postpaid plan and does not work with devices using Static Internet Protocol Addresses, prepay or business accounts, or accounts with more than 10 lines of service. FamilyBase is available on Push to Talk devices without an active Push to Talk feature. FamilyBase may not work outside Verizon Wireless coverage areas.

These Terms and Conditions apply to you and any individuals that use devices associated with your account and any individuals that otherwise access and use FamilyBase under your account, and you are responsible for your and/or their non-compliance with these Terms and Conditions. You are responsible for implementing and maintaining FamilyBase settings for devices on your account and explaining the limitations you impose on a user’s ability to access and use Verizon Wireless services. Upon activation of FamilyBase you will be charged the monthly subscription fee until you cancel the service, regardless of whether or not you have established any settings, limits or restrictions through ‘My Verizon’ or the FamilyBase Application. If you unsubscribe, are cancelled for non-payment, or are otherwise suspended from service, your settings will be lost.

FamilyBase is not guaranteed to be precise or accurate. All voice, data and messaging usage will be billed in accordance with the applicable plan, feature or bundle. Due to roaming, promotions, billing cycles, time zone settings,  specific settings selected and other implications/limitations that affect FamilyBase, you may incur overage charges based on actual usage in accordance with your plan or you may unexpectedly be prevented from using or being allowed to use certain services. Premium Messaging cannot be restricted and all fees and charges incurred will be billed in accordance with your plan.  Specific information about limitations and restrictions will be made available when you establish settings. Please read limit options and information carefully before selecting the setting.  Purchase Limits do not include minutes of use, messaging fees and data charges applicable with use of a service or application or monthly recurring fees for certain services and downloadable applications.  Data Limit calculations are based on actual data usage but depending on the setting selected, Data Limits may restrict use of all data services whether or not billable data usage applies.  If you have Mobile IM version 3.0 or higher on a 4G LTE device or if you are using third party messaging applications (such as iMessage), you will be able to use instant messaging or such third party applications, but such use will not be controlled or restricted by FamilyBase.  Additionally, FamilyBase does not restrict usage over Wi-Fi networks.

When you establish Time Restrictions, all data services will be unavailable during the restricted period, except for My Verizon Handset Login, Data Usage Meter and Backup Assistant.  In most cases, the FamilyBase Parent Application will always be accessible, even if a data limit is reached or when it is being accessed during a restricted time. However, the FamilyBase Parent Site on the iPhone and feature phones is not a device application and therefore, activities and controls on the FamilyBase Parent Site will not be accessible if the parent’s device is restricted from data usage (data limit reached).  When the FamilyBase Parent Site is accessed during unrestricted times, the user may be billed for data usage according to his/her data plan.  Analytics and Controls are always available on the FamilyBase pages on the My Verizon website.

For voice and messaging, during restricted times, the  user will only be able to place or receive calls and send or receive text, video and picture messages from Trusted Contacts and Voice Limits may prevent voice usage except for Trusted Contacts.

No restrictions are placed on a user’s ability to place and receive 911 calls. In the event that a user dials 911 from his/her handset, all FamilyBase voice restrictions and limitations will be automatically suspended to allow for open communications during the emergency.  This suspension of restrictions applies to calls to/from all numbers, including blocked numbers.  Voice usage restrictions will remain suspended until the Account Owner confirms that the emergency has passed and that FamilyBase should be reinstated for that line via My Verizon. Alerts to that effect will be sent to the Account Owner. All voice, data and messaging usage will be billed in accordance with the applicable plan, feature or bundle.

Only phone numbers, messaging short codes, email addresses, screen names and international numbers can be added as Blocked Contacts. You cannot block 911 or 611 calls. You may choose to block calls to 411, as well as calls received from “private”, “unavailable” or “restricted” callers. When you block calls to 411, calls to NPA-555-1212 will still be allowed and will be billed in accordance with the applicable plan, feature, or bundle. When you use Blocked Contacts, you will not receive notification of attempted delivery of a call/message from the blocked contact. Voice calls and text, video, or picture messages between Trusted Contacts will always be available.

Trusted Contacts can include phone numbers on your Verizon Wireless account or other phone numbers (including landlines and cell phones), email addresses, international numbers and screen names, and messaging short codes.  Voice usage associated with non-Verizon Wireless trusted contacts will count toward FamilyBase limits, unless calls are placed during free calling periods (i.e. Nights & Weekends). All messages (except those associated with Mobile to Mobile messaging) will count toward FamilyBase limits. However, all voice, data and messaging usage will be billed in accordance with the applicable plan, feature or bundle.

The FamilyBase Device Lock feature is independent of any other device lock features available through other products or services (including the Verizon Mobile Security suite), and will only work if an active FamilyBase Companion application has been installed on the child’s device. If your child is using a 4G LTE device and is on a voice call (including a 911 call) when the Account Owner or Account Manager locks that device, the call will terminate and the device will lock, but the child will be able to place another call to 911. If your child is using any other type of device and is on a voice call (including a 911 call) when the Account Owner or Account Manager locks that device, then the device will lock only after the voice call has ended but the child will be able to place another call to 911. Following a 911 call, the Account Owner and Account Manager will be unable to lock the applicable device until at least 24 hours have passed, and will receive an alert to that effect. When a device is locked, all communications, other than those to and from 911, will be prevented, including communications with Trusted Contacts.  Any FamilyBase restrictions or limits that have been set for the device prior to locking will remain in place when the device is unlocked. The Device Lock feature does not prevent data from being consumed on applications running in the background before the Device Lock is activated.  All data usage will be billed in accordance with the applicable plan, feature or bundle.

It is possible for the FamilyBase Companion application on the child’s device to be disabled, uninstalled or otherwise tampered with by the end user of that device.  If the child’s device is in Wi-Fi Only mode with no connection to the Cellular Network, or is in Airplane mode, the device lock will not function and it may take up to 24 hours for these device changes to be detected and communicated to the Account Owner and/or Account Manager. During this 24-hour period, the Account Owner and/or Account Manager, however, may continue to see a “locked” icon on My Verizon Web and/or within the FamilyBase Parent application.  The FamilyBase Companion application uses data, but the FamilyBase Companion application will not be blocked by other data restrictions placed on the device, such as Time Restrictions or “hard stop” data restrictions. The data consumed in supporting the FamilyBase Companion application will not be billed to your account.

FamilyBase is not able to monitor all contacts that a child has made.  For example, contacts in any social network, such as Facebook and Google+ whose contact information is not synced to your child’s address book are not monitored;  Voice calls made using Over the Top (OTT) apps such as Skype, Viber, etc are not monitored;  Messages sent/received using OTT apps such as WhatsApp, Facebook Messenger, AOL/Yahoo Messenger are not monitored;  Apps running in the background, such as Pandora, TuneIn Radio, MP3, and Podcasts are not monitored;  Apps running when the device screen is dimmed or off are not monitored.  However, if you have set data usage limits for the child’s device, all data usage described in this paragraph will apply against those data limits.

When an Account Owner or Account Manager is monitoring usage on devices with an active FamilyBase Companion application, the user will not be able to access, view, or store the content of voice calls, data sessions or messages sent or received on that device, but will be able to monitor to whom and from whom messages and calls are being sent and received. If a data restriction has been triggered on an Account Owner or Account Manager’s device, that person will not be able to use his/her device to view refreshed usage information on any monitored devices, but will be able to do so via My Verizon.  Verizon grants to you and you accept a limited, revocable, non-exclusive, non-transferable license to use software made available for you to access FamilyBase for your own individual use in the United States on the devices on which it was originally installed. FamilyBase is licensed and not sold to you. You will not sell, resell, distribute, loan, lease, otherwise transfer, copy, delete, record, translate, publish, upload, transmit, export, create derivative works of, make any commercial use of, modify, reverse engineer, decompile, or disassemble the software. You will not alter, disable, or circumvent any digital rights management security features embedded in the software. All rights not expressly granted to you herein are reserved. Verizon may revoke this license at any time.

In addition to other terms in the Customer Agreement,  TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VERIZON PROVIDES FAMILYBASE, INCLUDING ANY SOFTWARE COMPONENTS, ON AN “AS IS” BASIS WITH ALL FAULTS, ERRORS AND DEFECTS.

In addition to other terms in the Customer Agreement, TO THE EXTENT ALLOWED BY LAW, THE LIABILITY OF VERIZON, ITS LICENSORS AND SUPPLIERS FOR MONETARY DAMAGES FOR ANY CLAIMS THAT YOU MAY HAVE UNDER THESE TERMS OF SERVICE ARE LIMITED TO NO MORE THAN THE PROPORTIONATE AMOUNT OF THE SERVICE CHARGES ATTRIBUTABLE TO THE AFFECTED PERIOD. UNDER NO CIRCUMSTANCES ARE VERIZON, ITS LICENSORS AN AND SUPPLIERS LIABLE FOR ANY INCIDENTAL, CONSEQUENTIAL, PUNITIVE, MULTIPLE, OR SPECIAL DAMAGES OF ANY NATURE WHATSOEVER ARISING OUT OF OR RELATED TO PROVIDING OR FAILING TO PROVIDE FAMILYBASE, INCLUDING, BUT NOT LIMITED TO, LOST PROFITS, LOSS OF BUSINESS, OR COST OF REPLACEMENT PRODUCTS AND SERVICES.

You agree to indemnify, defend and hold Verizon, and its licensors and suppliers harmless from any claims arising out of or relating to your actions, including, but not limited to, your use of FamilyBase, your breach of these FamilyBase Terms and Conditions, your violation of any laws or regulations. For the avoidance of doubt, your obligations in this section apply with respect to the account holder and any users.
